{"id":1402,"date":"2018-08-08T20:18:32","date_gmt":"2018-08-09T00:18:32","guid":{"rendered":"http:\/\/groundbasedspacematters.com\/?p=1402"},"modified":"2018-08-08T20:18:32","modified_gmt":"2018-08-09T00:18:32","slug":"equivalent-level-of-safety-but-with-higher-burden-of-demonstration","status":"publish","type":"post","link":"https:\/\/groundbasedspacematters.com\/index.php\/2018\/08\/08\/equivalent-level-of-safety-but-with-higher-burden-of-demonstration\/","title":{"rendered":"Equivalent Level of Safety but with Higher Burden of Demonstration"},"content":{"rendered":"<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-1512 alignleft\" src=\"https:\/\/i0.wp.com\/groundbasedspacematters.com\/wp-content\/uploads\/2018\/08\/Screen-Shot-2018-08-08-at-8.17.04-PM-253x300.png?resize=253%2C300&#038;ssl=1\" alt=\"\" width=\"253\" height=\"300\" \/>On June 20, 2018, the FAA released <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2018-06-20\/pdf\/2018-13177.pdf\"><strong>a final rule<\/strong><\/a> that, among other things, expands options for satisfying the FAA&#8217;s commercial space transportation regulations.\u00a0 An applicant may, rather than satisfying an exact requirement or seeking a waiver, show that an alternative means of compliance satisfies a regulatory goal.<\/p>\n<p>An applicant for a license to operate a launch site under 14 C.F.R. part 420, for the launch or reentry of a reusable launch vehicle under part 431,for the reentry of a reentry vehicle that isn&#8217;t a reusable launch vehicle, or an applicant for an experimental permit may now demonstrate an equivalent level of safety rather than complying with the exact terms of a regulatory requirement.\u00a0 Part 417, which governs the launch of expendable launch vehicles, already allows applicants to demonstrate that an alternative approach may provide an equivalent level of safety to that imposed by regulation.\u00a0 For human space flight, the FAA now permits a demonstration of equivalence for pilot qualifications.<\/p>\n<p>As the FAA explained:<\/p>\n<blockquote><p>An equivalent level of safety provision allows an applicant to propose an alternative method to meet the safety intent of a current regulatory requirement, by providing a clear and convincing demonstration through technical rationale that the proposed alternative approach provides a level of safety equivalent to the requirement it would replace. An equivalent level of safety means an approximately equal level of safety as determined by qualitative or quantitative means.
