{"id":1944,"date":"2019-03-27T10:36:01","date_gmt":"2019-03-27T14:36:01","guid":{"rendered":"https:\/\/groundbasedspacematters.com\/?p=1944"},"modified":"2019-03-27T10:36:01","modified_gmt":"2019-03-27T14:36:01","slug":"draft-faa-notice-of-proposed-rulemaking-for-streamlining-launch-and-reentry-regulations","status":"publish","type":"post","link":"https:\/\/groundbasedspacematters.com\/index.php\/2019\/03\/27\/draft-faa-notice-of-proposed-rulemaking-for-streamlining-launch-and-reentry-regulations\/","title":{"rendered":"Draft FAA Notice of Proposed Rulemaking for Streamlining Launch and Reentry Regulations"},"content":{"rendered":"<p style=\"text-align: left;\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-1948 alignleft\" src=\"https:\/\/i0.wp.com\/groundbasedspacematters.com\/wp-content\/uploads\/2019\/03\/Screen-Shot-2019-03-27-at-10.29.11-AM-273x300.png?resize=235%2C258&#038;ssl=1\" alt=\"\" width=\"235\" height=\"258\" \/>After the FAA&#8217;s repeated insistence at COMSTAC last fall that it would not be sharing any drafts of its notice of proposed rulemaking (NPRM) for its launch and reentry regulations, guess what the FAA has done?\u00a0 It&#8217;s shared a draft.<\/p>\n<p>But don&#8217;t get too excited.\u00a0 The FAA is not seeking comments on this draft NPRM for further revisions right now.\u00a0 In other words, the FAA is not accepting comments prior to official publication. Instead, the FAA put up on its website <a href=\"https:\/\/www.faa.gov\/news\/updates\/media\/SLR2_NPRM.pdf\"><strong>a copy of what it sent<\/strong><\/a> to the Federal Register.\u00a0 Sharing the publication draft prior to Federal Register publication is a new thing for the FAA to do. I am told it was the last agency in the Department of Transportation to adopt this practice, but it&#8217;s on board now.<\/p>\n<p>OMB has cleared the NPRM, so the link contains what the FAA sent to the Federal Register for publication.\u00a0 As the FAA states in its cover sheet:<\/p>\n<blockquote><p>This draft notice of proposed rulemaking is not final and may change before publication. The comment period for this rule will open once the rule publishes in the Federal Register. The FAA is not accepting comments prior to that. When published, you may find the official notice of proposed rulemaking at the Federal Register\u2019s website.<\/p><\/blockquote>\n<p>You may ask whether it&#8217;s worth reading this draft if it could change before publication.\u00a0 Yes, it is.\u00a0 Do it.\u00a0 Even though it is a draft, the changes the Federal Register makes before publication are editorial, not substantive.\u00a0 The Register worries about such things as whether the regulatory text is punctuated and formatted properly, and whether any incorporations-by-reference are done properly.<\/p>\n<p><strong>A Head Start<\/strong>. The FAA&#8217;s willingness to share a copy of what it&#8217;s about to publish gives the public (that&#8217;s all of us) a head start on the comment period.\u00a0 When an agency publishes an NPRM, it provides the public a set amount of time in which to submit comments.\u00a0 This NPRM draft says the comment period will last 60 days. \u00a0 The FAA won&#8217;t start counting those 60 days until Federal Register publication, which should be sometime in the next couple of weeks. You&#8217;ll want to take full advantage of this head start given the impressive length of the document. It&#8217;s 580 pages double-spaced.<\/p>\n<p>Remember, the notice of proposed rulemaking is itself a draft of whatever final rule the FAA eventually issues.\u00a0 Now&#8217;s your chance to weigh in.<\/p>\n<p><strong>Press Release<\/strong>.\u00a0 The FAA has announced the availability of the draft NPRM, and <a href=\"https:\/\/www.faa.gov\/news\/updates\/?newsId=93306\"><strong>summarizes it here<\/strong><\/a>.\u00a0 The statement is not big on detail, but it says:<\/p>\n<blockquote><p>The proposed rule would provide a safe, performance-based regulatory approach to commercial space transportation. It would promote safety practices by creating flexibility for operators to meet safety requirements, and by enhancing collaboration among stakeholders.
