{"id":2965,"date":"2020-10-13T09:48:21","date_gmt":"2020-10-13T13:48:21","guid":{"rendered":"https:\/\/groundbasedspacematters.com\/?p=2965"},"modified":"2020-10-13T09:48:21","modified_gmt":"2020-10-13T13:48:21","slug":"nasa-fars-supplement-update-to-commercial-use-of-government-property","status":"publish","type":"post","link":"https:\/\/groundbasedspacematters.com\/index.php\/2020\/10\/13\/nasa-fars-supplement-update-to-commercial-use-of-government-property\/","title":{"rendered":"NASA FARS Supplement Update to Commercial Use of Government Property"},"content":{"rendered":"<p>On October 9, NASA released a <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2020-10-09\/pdf\/2020-20468.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">final rule<\/a> removing a section entitled &#8220;Use of Government property for commercial work\u2019&#8221; from NASA&#8217;s Federal Acquisition Regulations Supplement (NFS).\u00a0 NASA is doing so without providing an opportunity for comment because it views the change as an internal administrative procedure.\u00a0 Whether that&#8217;s correct is not clear.<\/p>\n<p><a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2020-10-09\/pdf\/2020-20468.pdf\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-2967 alignleft\" src=\"https:\/\/i0.wp.com\/groundbasedspacematters.com\/wp-content\/uploads\/2020\/10\/Screen-Shot-2020-10-09-at-1.37.49-PM.png?resize=180%2C185&#038;ssl=1\" alt=\"\" width=\"180\" height=\"185\" \/><\/a>If anyone affected by this change disagrees, NASA will withdraw the rule if it receives significant adverse comment.<\/p>\n<blockquote><p>A significant adverse comment is one that explains: (1) Why the final rule is inappropriate, including challenges to the rule\u2019s underlying premise or approach; or (2) why the final rule will be ineffective or unacceptable without change.<\/p><\/blockquote>\n<p>NASA describes the change as affecting no one but NASA:<\/p>\n<blockquote><p><a href=\"https:\/\/www.acquisition.gov\/nfs\/part-1845\" target=\"_blank\" rel=\"noopener noreferrer\">NFS Part 1845.301\u201371 Use of Government property for commercial work<\/a>, contains procedures and criteria related to the approval of non- government use of NASA equipment on commercial contracts that affect only the internal Agency administrative procedures and have no cost or administrative impact on contractors or prospective contractors.<\/p><\/blockquote>\n<p>Although NASA characterizes these procedures as internal, they are currently publicly available.\u00a0 One question that arises is whether their removal will make the process more difficult for NASA&#8217;s contractors to understand?\u00a0 Another questions that crops up is how the duration of approvals do not affect contractors?\u00a0 Could approvals now last different periods of time than currently contemplated?<\/p>\n<p><strong>Comments due<\/strong>:\u00a0 November 9, 2020<\/p>\n<p><strong>Effective date of change<\/strong>:\u00a0 December 8, 2020<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On October 9, NASA released a final rule removing a section entitled &#8220;Use of Government property for commercial work\u2019&#8221; from&hellip;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","enabled":false},"version":2}},"categories":[1],"tags":[],"class_list":["post-2965","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"jetpack_publicize_connections":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.9 -
