It gives me some assurance that the news reports of the UAE&#8217;s law may be correct.\u00a0 In it, the UAE government says its space agency shall embark on or contribute to such inspirational programs as: &#8220;[e]<span id=\"page104R_mcid779\" class=\"markedContent\"><span class=\"\" dir=\"ltr\" role=\"presentation\">xploration, mining, extraction and utilization of <span class=\"highlight selected appended\">resources<\/span> in space.&#8221;\u00a0 It doesn&#8217;t, however, say whether it&#8217;s the government or the private sector doing all that extracting and utilizing, so I remained riddled with doubt.\u00a0 However, the Policy also says it<span id=\"page110R_mcid854\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> will &#8220;abstain from activities that discourage or compete with UAE <\/span><\/span><span id=\"page110R_mcid855\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">commercial sector activities, unless required for critical national interests such as national security or <\/span><\/span><span id=\"page110R_mcid856\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">public safety.<\/span><\/span>&#8221;\u00a0 This suggests that once private UAE citizens start mining, the UAE government won&#8217;t compete on that front, and strongly implying that the private sector will get to keep its mining proceeds.\u00a0 Finally, the Policy states it will support, among other activities, &#8220;<span id=\"page110R_mcid862\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">projects that <\/span><\/span><span id=\"page110R_mcid863\" class=\"markedContent\">deal with the exploration and exploitation of <span class=\"highlight appended\">resources<\/span> in space, and other projects that may create a <\/span><span id=\"page110R_mcid864\" class=\"markedContent\">global revolution in the field of exploration, the utilization of space and its <span class=\"highlight selected appended\">resources<\/span><\/span>.&#8221;<\/span><\/span><\/p>\n<p>These concepts sound supportive of recognizing private rights in extracted resources.\u00a0 News articles such as <a href=\"https:\/\/spacenews.com\/nasa-offers-to-buy-lunar-samples-to-set-space-resources-precedent\/\" target=\"_blank\" rel=\"noopener noreferrer\">this one<\/a> say the UAE does.\u00a0 But, when writing a paper, we lawyers are supposed to footnote the law we claim to be describing.\u00a0 We&#8217;re even supposed to quote from it.\u00a0 But so far I can&#8217;t.<\/p>\n<p>Although I read neither French nor Japanese, I did find U.S. Library of Congress links to both Luxembourg&#8217;s and Japan&#8217;s laws on space resources.\u00a0 The Library of Congress even explains what those laws say.\u00a0 I&#8217;m pretty comfortable with citing those.\u00a0 If you can&#8217;t trust the Library of Congress, who can you trust?<\/p>\n<p>Lastly, since I&#8217;m asking you to share your link to the space resources UAE law (and hopefully an English translation) with me, I will share my Library of Congress links with you:<\/p>\n<p><a href=\"https:\/\/www.loc.gov\/item\/global-legal-monitor\/2017-08-22\/luxembourg-law-on-use-of-resources-in-space-adopted\/\" target=\"_blank\" rel=\"noopener noreferrer\">Luxembourg<\/a><\/p>\n<p><a href=\"https:\/\/www.loc.gov\/item\/global-legal-monitor\/2021-09-15\/japan-space-resources-act-enacted\/\" target=\"_blank\" rel=\"noopener noreferrer\">Japan<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>I&#8217;m working on a short essay on the status of property rights for outer space.\u00a0 One section of the essay&hellip;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","enabled":false},"version":2}},"categories":[1],"tags":[163,164,63,162],"class_list":["post-3417","post","type-post","status-publish","format-standard","hentry","category-uncategorized","tag-japan","tag-luxembourg","tag-property-rights","tag-uae"],"jetpack_publicize_connections":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.9 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Brother, Can You Spare a Footnote?
