Food"},"content":{"rendered":"<p>NASA and the Canadian Space Agency have teamed up to offer prizes awarded in three phases to teams who come up with new systems for providing nutritious, palatable and easy-to-prepare food in space.\u00a0 Currently, astronauts on the International Space Station eat a combination of fresh and pre-packaged shelf-stable food.\u00a0 They rely on re-supply from Earth.\u00a0 For longer duration lunar missions, or for voyages to Mars that can last months and years, more will be needed.\u00a0 Should we just send lots of chickens?<\/p>\n<p><img rel=\"noopener noreferrer\">here<\/a>.<\/p>\n<p>Being a lawyer and therefore dull as dirt, I headed straight for the rules.\u00a0 You may check out the video, and you should.\u00a0 It&#8217;s adorable and inspiring.<\/p>\n<p><strong>Basics.<\/strong>\u00a0 <span id=\"page37R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Phase<\/span> <span dir=\"ltr\" role=\"presentation\">2<\/span> <span dir=\"ltr\" role=\"presentation\">offers<\/span> <span dir=\"ltr\" role=\"presentation\">prize purses<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">$1,000,000<\/span> <span dir=\"ltr\" role=\"presentation\">US from NASA.\u00a0<\/span> <span dir=\"ltr\" role=\"presentation\">Phase<\/span> <span dir=\"ltr\" role=\"presentation\">2<\/span> <span dir=\"ltr\" role=\"presentation\">(including an initial registration period) will last approximately<\/span> <span dir=\"ltr\" role=\"presentation\">fifteen<\/span> <span dir=\"ltr\" role=\"presentation\">months.\u00a0 Having a Phase 3 depends on <span id=\"page37R_mcid22\" class=\"markedContent\">promising submissions in Phase 2 that demonstrate a viable approach to achieving the goals of the prize challenge. <\/span><\/span><\/span><\/p>\n<p>A quick review of the rules shows a couple items worth noting.<\/p>\n<p><strong>Intellectual Property<\/strong>.\u00a0 The rules address a participant&#8217;s rights to any intellectual property a participant proposes to use.\u00a0 For example, one of a contestant&#8217;s machines might be under a patent held by someone else.\u00a0 NASA&#8217;s rules say:<\/p>\n<blockquote><p><span id=\"page59R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Teams<\/span> <span dir=\"ltr\" role=\"presentation\">must<\/span> <span dir=\"ltr\" role=\"presentation\">explain who owns the intellectual property o<\/span><span dir=\"ltr\" role=\"presentation\">f the <\/span><span dir=\"ltr\" role=\"presentation\">proposed<\/span> <span dir=\"ltr\" role=\"presentation\">food production technology<\/span><span dir=\"ltr\" role=\"presentation\">. If the<\/span> <span dir=\"ltr\" role=\"presentation\">technology<\/span> <span dir=\"ltr\" role=\"presentation\">is built on existing or off<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">the<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">shelf <\/span><span dir=\"ltr\" role=\"presentation\">technology,<\/span> <span dir=\"ltr\" role=\"presentation\">Teams<\/span> <span dir=\"ltr\" role=\"presentation\">should detail the permissions (if applicable) they have to use that <\/span><span dir=\"ltr\" role=\"presentation\">technology. If a<\/span> <span dir=\"ltr\" role=\"presentation\">Team<\/span> <span dir=\"ltr\" role=\"presentation\">is p<\/span><span dir=\"ltr\" role=\"presentation\">art of an organization, the submission should<\/span> <span dir=\"ltr\" role=\"presentation\">indicate which<\/span> <span dir=\"ltr\" role=\"presentation\">Team <\/span><span dir=\"ltr\" role=\"presentation\">Members own the intellectual property.<\/span><\/span><\/p><\/blockquote>\n<p><span id=\"page90R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">NAS<\/span><span dir=\"ltr\" role=\"presentation\">A<\/span> and<span dir=\"ltr\" role=\"presentation\"> the Methuselah Foundation, which is the organization running the challenge, <\/span><span dir=\"ltr\" role=\"presentation\">claim no intellectual property rights from the Team. That part is good. According to the rules, all tra<\/span><span dir=\"ltr\" role=\"presentation\">de secrets, copyrights, patent, <span id=\"page93R_mcid0\" class=\"markedContent\">rights, and software rights will remain with each respective Team. <\/span><br \/>\n<\/span><\/span><\/p>\n<p>Appendix E also covers intellectual property, and it requires contestants to negotiate with NASA in good faith for NASA to use or hire someone else to use the contestant&#8217;s system if the contestant has intellectual property rights in the system:<\/p>\n<blockquote><p><span id=\"page110R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">To the extent the Team owns IP resulting from its <\/span><span dir=\"ltr\" role=\"presentation\">participation in the Challenge, the Team agrees to <\/span><span dir=\"ltr\" role=\"presentation\">negotiate in good faith wit<\/span><span dir=\"ltr\" role=\"presentation\">h NASA for a grant of a <\/span><span dir=\"ltr\" role=\"presentation\">nonexclusive, nontransferable, irrevocable license to <\/span><span dir=\"ltr\" role=\"presentation\">practice or have<\/span> <span dir=\"ltr\" role=\"presentation\">practiced for or on behalf of the United <\/span><span dir=\"ltr\" role=\"presentation\">States, the intellectual property throughout the world, at <\/span><span dir=\"ltr\" role=\"presentation\">reasonable compensation, if NASA chooses to pursue <\/span><span dir=\"ltr\" role=\"presentation\">such a lic<\/span><span dir=\"ltr\" role=\"presentation\">ense.<\/span><\/span><\/p><\/blockquote>\n<p>As this language makes clear, NASA does not commit to using the winner to furnish NASA&#8217;s space food requirements.<\/p>\n<p><strong>Insurance and Indemnification<\/strong>.\u00a0 Registrants must purchase insurance, and the rules provide details on how much.\u00a0 One item of concern is that the rules require that &#8220;<span id=\"page93R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The<\/span> <span dir=\"ltr\" role=\"presentation\">Team<\/span> <span dir=\"ltr\" role=\"presentation\">and all<\/span> <span dir=\"ltr\" role=\"presentation\">Team Members<\/span> <span dir=\"ltr\" role=\"presentation\">jointly and severally agree<em> to indemnify <\/em><\/span><span dir=\"ltr\" role=\"presentation\">the U.S. Government and<\/span> <span dir=\"ltr\" role=\"presentation\">the Methuselah Foundation<\/span> <em><span dir=\"ltr\" role=\"presentation\">against third<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">party claims for damages <\/span><span dir=\"ltr\" role=\"presentation\">arising from or related to<\/span> <span dir=\"ltr\" role=\"presentation\">Challenge<\/span> <span dir=\"ltr\" role=\"presentation\">activities.<\/span><\/em><\/span><em>&#8220;<\/em> (emphasis added).\u00a0 This appears too broadly worded.\u00a0 As written, Team A might have to indemnify the government and the foundation for harm Team B causes to third parties.\u00a0 Is this fair, given that Team A will likely have no control over Team B?\u00a0 One wonders, as well, whether NASA sought to deter individuals from participating with this requirement.<\/p>\n<p><strong>Registration deadline<\/strong>:\u00a0 February 28, 2022<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NASA and the Canadian Space Agency have teamed up to offer prizes awarded in three phases to teams who come&hellip;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","enabled":false},"version":2}},"categories":[1],"tags":[166],"class_list":["post-3535","post","type-post","status-publish","format-standard","hentry","category-uncategorized","tag-space-settlement"],"jetpack_publicize_connections":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.9 -
